One of the main contents of the regulations is to standardize leasing behavior and balance the rights and obligations of both parties to the lease. Strict requirements are put forward for housing rental, and it is clearly stipulated that group renting is prohibited. Kitchens, bathrooms, balconies, storage rooms and other non-residential spaces cannot be rented out for living alone. The house is for rent.

According to the regulations, Shanghai strengthens the management of market entities and regulates the order of the housing rental market. For “secondary landlords”, the regulations stipulate that individuals who sublease housing for profit for the purpose of reaching the specified number must go through registration in accordance with the law. The regulations clearly state that Shanghai implements a real-name employment system for employees of housing leasing companies and real estate brokerage agencies, and housing leasing companies and real estate brokerage agencies should apply for employment information cards for employees. In addition, housing leasing companies that lease individual housing for subleasing business shall open a special account for the supervision of housing leasing transaction funds in commercial banks in accordance with regulations, and publicize it to the public through the housing leasing platform.

At the same time, the regulations set up a special chapter to regulate affordable rental housing. According to the Regulations, affordable rental housing shall be arranged mainly in new towns and other population-introduced areas, university parks, industrial and commercial agglomeration areas, rail transit stations and other areas with concentrated rental demand, convenient production and living, and convenient transportation.

For “rent increase”, the regulations clearly stated that the housing management department in Shanghai should establish a housing rental price monitoring mechanism, Do a good job in relevant early warning work. When the housing rent has risen significantly or is likely to rise significantly, price intervention measures such as price increase declaration, rent limit or rent increase may be adopted in accordance with the law to stabilize the rent level.

The regulations also stipulate that Shanghai shall establish and improve a unified city-wide The housing rental public service platform makes full use of information technology, promotes data sharing, innovates service methods, and improves management efficiency.

The regulations will come into force on February 1, 2023.
