According to the administrative penalty decision, on December 29, 2021, the law enforcement officers of Guangzhou Baiyun District Market Supervision Administration went to the scene of Bawang (Guangzhou) Co., Ltd. located at No. 468, Guanghua 3rd Road, Baiyun District, Guangzhou. After inspection, it was found that the advertisements published on the promotional pages of some products sold on the WeChat applet contained false advertising content, which was suspected of publishing false advertisements.
After investigation, the products sold by the parties on their WeChat mini-programs from May 2020 to December 2021: 1. Ben Cao Tang rosy and bright gift box (100g rosy and radiant gift box) Facial cleanser + 110ml ruddy radiant beauty conditioning water + 100ml ruddy radiance and beauty curd + 30ml ruddy radiance and beauty conditioning water (gift) + 7g rosy radiance and beauty essence cream (gift)) The promotional page is marked with “Skin rosy and white “Farewell to the yellow-faced woman”, “drive away the yellow gas”, “ruddy and white”, “melanin precipitation, more and more spots”, “fair skin”, “freckles, pigmentation, yellow gas, dullness”, “improve dark yellow”” Functional propaganda words such as “Conditioning and whitening”, “…to brighten the skin”, etc.; 2. The promotional page of the rosy and radiant facial cleanser (net content 100g) is marked with “beautifying and whitening…” “brightening and whitening”” Functional promotion words such as “improve dark yellow” and “repel dark yellow face”; 3. Bawang antibacterial hand sanitizer (honeysuckle moisturizing type + ginger refreshing type, net content 500g) publicity page is marked with “effective 99% sterilization”, “efficient sterilization…” and other terms; 4. Litao sterilization and stain removal 2-in-1 laundry detergent (net content 2KG) is marked with terms such as “effectively kills 99% of bacteria” on the promotional page.
After verification, the herbal rosy radiance gift box and rosy radiance facial cleanser sold by Bawang (Guangzhou) Co., Ltd. have not obtained the administrative license for domestic special-purpose cosmetics and belong to ordinary cosmetics. does not function as advertised. Bawang (Guangzhou) Co., Ltd. sells Bawang antibacterial hand sanitizer and Litao 2-in-1 laundry detergent for sterilization and stain removal. The test report does not have no sterilization test items, and does not have the functions it claims. The above advertising information released by Bawang (Guangzhou) Co., Ltd. is false information, which is inconsistent with the actual situation, and deceives and misleads consumers.
From May 2020 to December 29, 2021, Bawang (Guangzhou) Co., Ltd. sold 58,464 yuan in sales of the Herbal Tang Ruddy Brightening Gift Box; 2028 yuan; sales of Bawang antibacterial hand sanitizer was 2147 yuan; sales of Litao sterilization and stain removal 2-in-1 laundry detergent was 4683 yuan. The total sales of the above four products on Bawang (Guangzhou) Co., Ltd.’s WeChat applet totaled 67,322 yuan. The above advertisements published by Bawang (Guangzhou) Co., Ltd. were edited and published on the WeChat applet of the parties themselves, and it was determined that the advertising costs could not be calculated.
In view of the above-mentioned violations of comprehensive advertising laws and regulations, the Baiyun District Market Supervision and Administration Bureau of Guangzhou City decided to impose a fine of 600,000 yuan on Bawang (Guangzhou) Co., Ltd.
According to Bawang’s official website, Bawang International (Group) Holdings Co., Ltd.‘s industries involve high-tech biotechnology, daily fine chemicals, international trade and many other fields. Tao, Bencaotang, Xiaobawang and other brand products covering traditional Chinese medicine hair care, traditional Chinese medicine beauty and other fields. Bawang (Guangzhou) Co., Ltd., a subsidiary of the Group, is a key enterprise and a major taxpayer in Guangzhou.
