What are the standards for the appraisal of work-related disability?

Standards for Grade Appraisal of Work Injury and Disability

After workers and employers apply for appraisal of the grade of disability, the work ability appraisal committee shall conduct the appraisal according to the “Work Ability Appraisal–Worker Injury and Disability due to Occupational Diseases”. “Grade” stipulates that labor ability appraisal shall be made. The classification criteria for work-related injury and disability are (decreasing in severity):

Level 1: organ loss or absolute loss of function, other organs cannot be compensated, there is special medical dependence, and life is absolutely or mostly impossible Self-care;

Grade 2: severe organ defects or deformities, serious dysfunction or comorbidities, special medical reliance, or most of the life cannot take care of themselves;

Grade 3: serious organs Defects or deformities, serious dysfunction or comorbidities, special medical reliance, or inability to take care of parts of life;

Corresponding compensation content

1. First-grade to fourth-grade disability

(1) One-time disability subsidy, the standard is: first-grade disability 27 months of my salary, 25 months of my salary for a second degree disability, 23 months of my salary for a third degree of disability, and 21 months of my own salary for a fourth degree of disability;

(2) Monthly disability allowance, the standard is: first-level disability is 90% of my salary, second-level disability is 85% of my salary, third-level disability is 80% of my salary, fourth-level disability is 80% of my salary 75% of my salary. If the actual amount of disability allowance is lower than the local minimum wage standard, the difference shall be made up by the work-related injury insurance fund.

2. Level 5 to Level 6 disability

(1) One-time disability subsidy, the standard is: Level 5 disability is 18 months of my salary, Level 6 Disability is 16 months of my salary;

(2) Monthly disability allowance, the standard is: 70% of my salary for the fifth degree of disability, 60% of my salary for the sixth degree of disability , and the employer shall pay various social insurance premiums for it in accordance with the regulations. If the actual amount of disability allowance is lower than the local minimum wage standard, the employer shall make up the difference.

3. Level 7 to Level 10 Disability

One-time disability subsidy, the standard is: Level 7 disability is 13 months of my salary, Level 8 disability is 11 months’ salary, 9 months’ salary for grade 9 disability, 7 months’ salary for grade 10 disability.
