On April 12, the Cili County People’s Court tried through the “cloud court trial” mode and pronounced a verdict in court. In the drug trafficking case, the defendant Tan Moumou was sentenced to one year in prison, fined 5,000 yuan, and recovered 750 yuan of illegal gains.
[It was found out after the trial] At about 14:00 on December 31, 2021, the defendant Tan Moumou and the drug addict Gong Mou contacted the drug dealer by phone. That afternoon, Tan sold a “heroin bun” to Gong on a street in Yongding District, and charged 750 yuan paid by Gong through a QR code; at 21 o’clock that night, Gong called Tan again to ask for a purchase. For drugs, Qin Moumou and the online drug dealers agreed to trade drugs near a community in Yongding District. When picking up the goods, the public security police arrested him on the spot, and seized 1 piece of heroin on the spot, with a net weight of 0.88 grams after weighing; January 1, 2022, Gong took the initiative to explain the situation to the public security organ, and on January 11 of the same year, he handed over the heroin he bought from Tan to the Cili County Public Security Bureau. The net weight was 0.22 grams after weighing.
[The court of first instance held that] the defendant Tan Moumou violated the state’s drug management system and sold 1.1 grams of heroin, which constituted the crime of drug trafficking. The facts of the crime are clear, the evidence is reliable and sufficient, and the crime charged by the public prosecution organ is convicted. Defendant Qin Moumou was sentenced to fixed-term imprisonment or more for an intentional crime. After the execution of the sentence, if he commits a crime that should be sentenced to fixed-term imprisonment or more within five years, he is a repeat offender and should be given a heavier punishment; If you commit a crime, you must confess and voluntarily plead guilty and accept punishment, and you can be given a lighter punishment in accordance with the law. The judge then made the above judgment.
