On March 11, the State Tobacco Monopoly Administration issued the “Measures for the Administration of Electronic Cigarettes”, which stipulates that the sale of flavored electronic cigarettes other than tobacco flavors and electronic cigarettes that can be added with atomizers are prohibited. Because the various flavors of e-cigarettes can induce minors to smoke, the above regulations will play an important role in protecting minors from e-cigarettes. It is reported that the “Measures” will come into force on May 1, 2022.
The “Measures” consists of six chapters and forty-five articles, including general provisions, production and quality management, sales management, import and export trade and foreign economic and technological cooperation, supervision and inspection, and supplementary provisions. Its main contents are: first, clarify the definition and supervision objects of e-cigarettes; second, implement license management for the production, wholesale and retail entities of e-cigarettes. There are no new types of administrative licenses for e-cigarette license management, but only in tobacco monopoly production and wholesale. Add corresponding items to the scope of licensing and retail licenses; the third is to implement channel management for e-cigarette sales, establish an e-cigarette transaction management platform, and standardize the sales methods of e-cigarettes; the fourth is to manage the quality of e-cigarette products throughout the process, and establish e-cigarette products. Technical review and tracking and tracing mechanism; the fifth is to supervise the transportation and import and export of electronic cigarettes according to law.
It is worth noting that Article 22 of the Measures stipulates that the sale of e-cigarette products to minors is prohibited, and e-cigarette operators should set a prominent position not to sell e-cigarettes to minors The signs of electronic cigarettes should require them to show their ID documents if it is difficult to tell whether they are minors.
The industry believes that licensed operation is an important measure to regulate the development of the electronic cigarette industry. In this regard, the “Measures” clarified that electronic cigarette manufacturers, atomizer manufacturers and nicotine manufacturers for electronic cigarettes must obtain a tobacco monopoly production enterprise license and be approved and registered by the market supervision and management department.
The State Tobacco Monopoly Administration also released the National Standard for Electronic Cigarettes on the same day (second draft for comments). Compared with the first draft for comments, the number of atomizer additives has been reduced from 122 to 101, and it is required that all components in the cartridge should be printed on the product. Previously, some e-cigarette products have been criticized for their unclear nicotine content and unknown added ingredients.
