Lv Mouyuan, a Class 2020 undergraduate student majoring in clinical medicine at Dalian Medical University, was given a one-year detention by the school for secretly photographing a girl in the restaurant public toilet.
The candid filming incident occurred at around 8:00 pm on May 15, 2022. Dalian Medical University issued a notice on the punishment decision for the student on May 17. The notice stated: (candid filming) was After the discovery, he was brought to the security department for investigation. The student admitted the above facts and was able to recognize the mistakes he had made.
As soon as the results of the school’s punishment were released, there was dissatisfaction and heated discussions online. Before the results of the school’s punishment were released, a student who claimed to be Dalian Medical University posted information about the incident through Weibo, and was “covered” by the school, which also made many netizens angry.
College students’ candid camera incidents occur from time to time, and the school’s handling results vary. On the evening of September 15, 2021, Hu, a freshman at Hubei University of Technology, was caught on the spot when he secretly photographed the bottom of a girl’s skirt in the school playground. The school decided to initiate a persuasion procedure for him, and notified the parents of Hu’s situation and the school’s opinions. Hu and his parents agreed to withdraw from school automatically and left the school on the morning of September 16.
On June 8, 2021, the School of Finance of Central University of Finance and Economics also issued a “handling notice”. Nie, a student of the school, was expelled from his student status for serious disciplinary violations. According to media reports, the student’s so-called serious violation of discipline was to secretly photograph a girl in the toilet of the teaching building.
It is worth mentioning that Dalian Medical University is not the only university that is more tolerant of candid photography incidents. On the evening of December 4, 2021, a boy from Dalian Maritime University entered the women’s toilet to take pictures secretly. , was also given a school probation.
In addition, on November 18, 2021, Li Moumou, a student of Xi’an International Studies University, was caught secretly filming in the women’s toilet. On December 2, the school issued a “Situation Bulletin” and gave Li Moumou a school probation.
As for the punishment of such incidents, Professor Wang Yue from the Department of Medical Ethics and Law, School of Medical Humanities, Peking University believes that it is very necessary for the school to punish such students, and this kind of behavior is not only a moral aspect It has also violated the Public Security Administration Punishment Law, and strictly speaking, its corresponding administrative responsibility can be investigated.
According to Article 42 of the “Public Security Administration Punishment Law of the People’s Republic of China”: Anyone who commits any of the following acts shall be detained for not more than five days or be fined not more than 500 yuan; , shall be detained for not less than five days but not more than 10 days, and may concurrently be fined not more than 500 yuan. Voyeurism and candid photography are included in these acts.
Professor Wang Yue also pointed out that there is a big problem in our higher education at present, that is, schools lack a certain degree of autonomy. “That is to say, the school cannot make administrative sanctions against the parties based on the case-by-case review of its own academic committee or ethics committee, so it is punished according to the relevant provisions, and sometimes the punishment results are either too light or too severe.”
The student at Dalian Medical University is a clinical medicine major, so it is very likely that he will become a doctor in the future. Deng Liqiang, executive director of the China Society of Health Law and deputy director of Beijing Huawei Law Firm, believes that taking pictures of women’s toilets secretly must be a very serious matter in light of the characteristics of the profession of a doctor. “A doctor is a profession that requires a high moral component, so it is not enough for a doctor to just obey the law, because the patient entrusts the doctor with his own health and life, and at the same time involves his dignity and privacy, so the moral requirements for doctors are by no means. Moral kidnapping, but the characteristics of the profession itself. As a medical student, in the process of learning, you should deliberately shape your own moral bottom line and understand the characteristics of the profession of a doctor.”
In the “Physician Law of the People’s Republic of China”, which was implemented on March 1 this year, for the first time, a description of a physician’s lifetime ban from practice was added. Article 58: For serious violations of doctors’ professional ethics and medical ethics, causing bad social impact, the competent health department of the people’s government at or above the provincial level shall revoke the doctor’s practice certificate or order it to stop illegal practice activities, and be prohibited from engaging in medical treatment for five years or life. Health services or medical clinical research.
The “Physician Law” is for doctors. After a medical student made a candid photo of a girl’s toilet, and later became a doctor, how could he still obtain patients, especially female patients? trust? Is such a person still suitable for a career as a doctor?
In this regard, Professor Wang Yue said that if a doctor commits molestation to a female patient, he may be banned from practice for life, but the life-long ban on the doctor’s law does not apply. Yu medical student candid photo incident.
Lawyer Deng Liqiang believes that if the medical student not only secretly filmed the video, but also spread it, the nature of the incident would have changed, and he should not be allowed to pursue a career as a doctor. “But at present, the spread is only a possibility. After all, it has not happened yet. Therefore, it should be dealt with severely, and at the same time, it should be given educational influence and a chance to reform.”
College voyeurism and candid photography occur frequently. According to reports, this has formed an industrial chain. Regarding the candid photography, “Life Times” once published an analysis article written by Song Chongsheng, deputy chief physician of the psychiatry department of Beijing Huilongguan Hospital. Dr. Song pointed out that there is a corresponding psychological barrier about secret photography and voyeurism – voyeurism.
Dr. Song wrote: People with this habit have a lack of interest in ordinary, normal sex, and even show impotence. Some people take risks in order to satisfy their hobbies, such as drilling toilets, using reflectors, and even using cameras. If there is voyeurism, be sure to seek professional help.
Liao Yanhui, Deputy Chief Physician of the Department of Mental Health, Shaw Hospital Affiliated to Zhejiang University School of Medicine, is mainly engaged in the research and treatment of addictive behaviors. Regarding the candid photography, Liao Yanhui believes that if it is not for profit from selling money, it must be a psychological disorder.
Although this kind of behavior can be classified as a psychosexual disorder, in the opinion of Professor Yao Guizhong, the former vice president of Peking University Sixth Hospital, this kind of behavior can hardly be regarded as a disorder. This kind of disease, he said that in his more than 30 years of psychiatry career, he has never diagnosed such a person as a disease. “There is a personality disorder in the international classification, but this kind of situation is not considered a disease, and there is no medicine to treat it, so we can deal with it as we should, and punish it as we should. There is nothing to say.”
As for the person who has this habit of secretly taking pictures, Yao Guizhong said: “If he feels that he has a psychological problem, or if the situation is repeatedly uncontrollable, he can seek psychological counseling, but certainly not Force him to go, because there is no reason to force a person.”
